  • How did Motor Finance claims start?

    A recent Financial Conduct Authority (FCA) investigation discovered widespread evidence of mis-selling on all types of vehicle financing.

    Customers were offered finance packages, to purchase their car, including PCP, hire purchase, contract hire and car loans, that included hidden/secret commissions paid to the car dealership or salesperson.

    Car dealerships and salespersons were incentivised to offer finance packages with higher interest rates to increase their own commission.

    This meant that customers were unfairly paying more than they should.

  • How do I know if I was mis-sold?

    You can claim for any mis sold car finance agreement that you entered within the last 10 years.

    If you bought the car on finance and were not told about the amount of commission the dealership or salesperson was receiving from the company that provided the finance, then you may be able to claim compensation.

    It is the responsibility of the car dealership to explain the finance options clearly to you:

    Did the salesperson adequately explain the finance packaged they offered you?
    Were all finance options that were available explained to you?
    Were all interest rate options explained to you?
    Was the best interest rate available offered to you?

  • What is hidden commission?

    Hidden commission is where the car dealer sells you the finance package for the car but does not tell you that they are getting a commission or how much commission that are getting.

    If the payment of commission and the amount of commission has not been explained, then you can make a claim for compensation.

  • What is the claim process?

    The FCA has extended a pause on complaints as it continues its investigation into the motor finance industry.

    When the regulator confirmed this work, they paused the 8-week deadline for motor finance firms to provide a final response to relevant customer complaints.

    The 8-week deadline for firms to respond to motor finance complaints involving a DCA has been paused. Under the FCA proposals, firms will not have to issue a final response to DCA complaints until after 4 December 2025 at the earliest.

    We will contact the finance company and ask them to supply all the relevant documents and contracts on your behalf to see if determine if a discretionary commission model or fixed fee commission was in place, what the interest / APR rates of your credit agreement were, what the commission amount was and what interest rate you could have been offered at the time as an alternative.

    If we review the documentation and we do not think you have a compensation claim to make we won’t charge our fee and we will close your complaint.
